Empyreal Infotech ("we", "us", "our") provides software engineering services to agencies, startups, and direct clients globally. This Privacy Policy explains what personal information we collect when you visit empyrealinfotech.com or engage us for project work, how we use it, and your rights.
We collect only what is necessary to operate the business and deliver services. We do not sell your data, ever.

What we collect
Information you provide directly
- Contact details: name, email, company, role, when you submit forms or email us.
- Project information: documents, codebases, system access, requirements you share during engagements.
- Payment information: processed via third-party processors (Stripe, bank transfer). We do not store full card numbers.
Information collected automatically
- Device & usage data: browser, OS, pages visited, referring URL, approximate location (city-level).

- To respond to inquiries and deliver contracted services.

Who we share it with
We share personal data only with parties strictly necessary to deliver services:
- Infrastructure providers: hosting, email, analytics (e.g. Cloudflare, Google Workspace).
- Payment processors: Stripe and our banking partners.
- Legal authorities: only when compelled by valid legal process.
We never sell, rent, or trade your personal information.

Wherever you live, you have the right to:
- Access the personal data we hold about you.
- Request correction or deletion of inaccurate or outdated information.
- Withdraw consent or object to processing (where applicable).
- Request a copy of your data in a portable format.
- Lodge a complaint with your local data protection authority.

Security
We apply industry-standard technical and organisational measures:
- Encryption in transit (TLS 1.3) and at rest where supported.
- Principle of least privilege on internal systems and client environments.
- Regular access reviews. Two-factor authentication on all critical tooling.
- Vendor due diligence before sharing client data.
No system is perfectly secure. We disclose qualifying breaches to affected parties within 72 hours of confirmation.

Retention
We retain personal data only as long as necessary:
- Inquiry data: up to 24 months from last contact.
- Active client data: for the duration of the engagement plus 7 years for accounting and audit purposes.
- Source code and project artifacts: handed over to the client; we keep a backup for 90 days post-handover, then delete.

Cookies
We use a minimal set of cookies:
- Essential: required for the site to function (session, security).
- Analytics: aggregated, anonymised pageview tracking. No cross-site profile.
You can disable cookies in your browser. Essential cookies are session-based and removed when you close the browser.

Scope of work
Each engagement is governed by a signed proposal or statement of work (SOW) that defines deliverables, timeline, milestones, and acceptance criteria. Anything outside the agreed scope is treated as a change request and re-estimated before work begins.
No silent scope creep. If we believe the work has expanded, we flag it within 24 hours and pause the affected stream until we agree the next step.

Pricing & invoicing
- Hourly engagements: $45–75/hr depending on seniority and scope. Time tracked in 15-minute increments.
- Sprint-based: fixed price per 2-week sprint. Invoiced at sprint kickoff.
- Dedicated team: monthly retainer billed first business day of the month.
Net 14 payment terms unless agreed otherwise. Invoices accepted via bank transfer or Stripe. Late balances over 30 days accrue 1% monthly interest.

IP rights
On final payment, all custom code, designs, and deliverables produced during the engagement are assigned to the client.
We retain rights to:
- Generic libraries, internal tooling, and frameworks we developed prior to or independently of the engagement.
- Open-source components used per their respective licences.
- The right to publicly reference the engagement (logo, project type) unless restricted in writing.

Confidentiality & NDA
We treat all client information as confidential by default. We are happy to sign your NDA, or you can use our standard mutual NDA — download here.
Confidentiality obligations survive termination of the engagement indefinitely.

Warranty & liability
We warrant that delivered work substantially conforms to the agreed specifications for 30 days post-delivery. Defects reported in this window are remediated at no additional cost.
Our aggregate liability under any engagement is limited to fees paid in the 3 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.

Termination
Either party may terminate any engagement with 14 days written notice. Work-in-progress is invoiced through the termination date. Source code, credentials, and assets are handed over within 7 business days.

Governing law
These terms are governed by the laws of England & Wales for clients in the UK, EU, and Africa, and by the laws of India for all other clients, unless agreed otherwise in the SOW. Disputes are resolved through good-faith discussion first; arbitration where required.
